Ontario statement of claim (Superior Court)

Ontario Superior Court of Justice · ON

Within 20 days

Act now — short deadline

  • Statement of defence within 20 days after service if served in Ontario; 40 days elsewhere in Canada or the USA; 60 days anywhere else (r.18.01)
  • A notice of intent to defend (Form 18B) can be delivered within the same time (r.18.02)

What this usually means

Someone has started a lawsuit against you in Ontario. A lawsuit filing counts as a known claim, closing the pre-claim planning window. Without a statement of defence in time, the defendant can be noted in default (Rule 19).

Don't move, gift or retitle assets. Talk to an advisor first.
